Release and Indemnification Agreement

Please read carefully!

This is a release of liability and waiver of certain legal rights while:

Sailing, Passage Making, Training or any other activity while on the boat.

  1. I wish to fully participate as a working crew/passenger while on any boat being operated by MoonLight Sailing LLC and I acknowledge that my participation is completely voluntary.

  2. I understand that there are inherent risks involved with boating, including, but not limited to equipment failure, perils of the sea, harm caused by other vessels, acts of fellow participants, entering into the water, boarding or disembarking boats, and activities on the dock.

  3. I fully assume responsibility for my own safety (including, without limitation, following all directions of the captain and mate/crew) while participating in all boating activities, and verify that I am physically able to participate.

  4. I fully understand that the involved boat has limited medical supplies/facilities, (first aid kit), and that in the event of illness or injury medical care must be summoned by radio and treatment will be delayed until I can be transported to a medical facility. I agree to pay any and all financial cost to the provider of transportation and medical facility treatment. I agree in advance to all of these conditions.

  5. Having read this waiver, I agree to RELEASE from LIABILITY and HOLD HARMLESS MoonLight Sailing LLC, along with respective officers, directors, employees, owners, members, managers, affiliates, agents, attorneys, heirs, and all individuals and entities having an interest in the boat being used by MoonLight Sailing LLC from any and all liability, claims, demands, equitable relief, damages, costs, expenses, and causes of action or character, of any type or nature whatsoever (including negligence), arising out of sailing training.

  6. I authorize MoonLight Sailing LLC to use photographs, personal narrative, interviews or video recordings of my participation for any marketing purposes.

I have carefully read the preceding release and indemnification, understand the contents, and sign this release as my own free act.
